Acceptance of the Terms of Use
Welcome to the website of Condado Tacos (“Condado,” “we,” “our,” or “us”). These Terms of Use (“Terms”) apply when you use the www.condadotacos.com website, mobile application, or other Condado online service (collectively, the “Website”). These terms are a legal contract between you and Condado, so it is important that you review them carefully before using the Website. Your use of the Website indicates that you have read, understood, and agree to follow and be bound by the Terms, which incorporate by reference, our Privacy Policy and other documents such as our Service Agreement. If you do not agree to the Terms, do not access or use the Website. Any capitalized terms not defined in these Terms will have the same meaning as defined in our Service Agreement.

This Website is offered and available to users who are 18 years of age or older, and reside in the United States or any of its territories or possessions. The Website is not directed at people under the age of 13, and the Website does not knowingly collect any personal information from such people. By using this Website, you represent and warrant that you are of legal age to form a binding contract with Condado and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

Changes to the Website
We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Website thereafter.

Your continued use of the Website following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

Your Access to The Website
We may choose to suspend your access to all or part of the Website without notice and at any time, for violations of these Terms, for any reason, or for no reason at all. We are not liable if for any reason all or any part of the Website is unavailable at any time or for any period.

To access the Website or some of the resources it offers, you may be asked to provide certain registration details or other information. It is a condition of your use of the Website that all the information you provide on the Website is correct, current and complete. You agree that all information you provide to register with this Website or otherwise, including but not limited to through the use of any interactive features on the Website, is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy. We have the right to disable any user name, password or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason.

Website Content and Intellectual Property Rights
The Website and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof) (“Website Content”), are owned by Condado, its licensors or other providers of such material and are protected by United States and international intellectual property or proprietary rights laws. Condado expressly reserves all rights in the Website and Website Content owned and licensed by Condado.

These Terms permit you to use the Website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our Website, except as authorized in writing by us.

If you wish to make any use of material on the Website other than that set out in this section, please address your request to: compliance@condadotacos.com.

Revolucion Holdings, Inc. “Condado Tacos” (Tacos, Tequilas, Margaritas) and all related names, logos, product and service names, designs and slogans (“Condado Marks”) are trademarks of Condado or its Affiliates or licensors. You must not use the Website Content, Condado Marks, other Condado intellectual property, including but not limited to copyrights, without the prior written permission of Condado. All other names, logos, product and service names, designs, slogans, images, and sounds on this Website are the trademarks, copyrighted material, or intellectual property of their respective owners.

Any opinions, advice or recommendations expressed therein are those of the users providing such content and not those of Condado. We do not endorse any content, or any opinion, recommendation or advice expressed therein. It is not our intent to discourage you from taking controversial positions or expressing vigorously what may be unpopular views; however, we reserve the right to take such action as we deem appropriate in cases where the Website is used to disseminate statements that are harmful or inflammatory.

Prohibited Uses
You may use the Website only for lawful purposes and in accordance with these Terms and the Acceptable Usage section in the Service Agreement. You understand, acknowledge and agree that you will not take any of the following actions with respect to our Website, Website Content, Condado Marks nor will you use our Website or related software to upload, post, email, distribute, transmit, link, solicit or otherwise make available any content or use our Website in any manner that:

Violates any applicable federal, state, local or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries);
Is unlawful, harmful to minors, threatening, harassing, abusive, defamatory, slanderous, vulgar, gratuitously violent, obscene, pornographic, indecent, lewd, libelous, harassing, invasive of another’s privacy, or racially, ethnically or otherwise offensive, hateful or abusive; or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise deemed inappropriate at our sole discretion;
Infringes someone else’s patent, trademark, trade secret, copyright or other intellectual property, proprietary or other rights;
Produces spam or spin publicizing a product, website, event, entity or individual person;
Posts or disseminates advertisements or solicitations of business, or otherwise engage in commercial activity on our Website unless you have a business account, except in those areas specifically designated for such purpose (e.g., classified bulletin board);
Systematically collects and uses any Website Content or other content including the use of any data mining, or similar data gathering and extraction methods;
Uses any device, software or routine that interferes with the proper function, security, or availability of the Website;
Attempts to disable, bypass, modify, defeat or otherwise circumvent any of the digital rights management or other security related tools incorporated into the software or any Website Content or the Website;
Creates a false identity for the purpose of misleading others;
Impersonates or attempt to impersonate Condado, a Condado employee, another user or any other person or entity (including, without limitation, by using domain names, email addresses, screen names or social networking IDs associated with any of the foregoing);
Provides material support or resources (or conceals or disguises the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;
Engages in unauthorized “scraping” or spidering, or harvesting of personal information, or use any unauthorized automated means to compile information;
Engages in any other conduct that interferes, restricts or inhibits anyone’s use or enjoyment of the Website, or which, as determined by us, may harm Condado, the Website, or users of the Website or expose them to liability; or
Removes any proprietary notices or labels on our Website Content or any other content.

Indemnity
All the information you submit to the Website remain your responsibility. Specifically, you agree to hold Condado, the Website, our Affiliates, Operational Service Providers, each associated officer, shareholder/director, employee, agent, representative and, and any of their successors and assigns, harmless from against any claims, costs, damages, losses, expenses, and any other liabilities, including attorneys’ fees and costs, arising out of or related to your access to or use of the Website, your violation of these Terms, and/or your violation of the rights of any third party or person.

No Warranties
The Website is provided “as is” and without warranty of any kind. To the maximum extent permitted by law, Condado, our Affiliates and Operational Service Providers disclaim any and all warranties, express or implied, including (but not limited to) implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights, or any other warranty, condition, guarantee or representation, whether oral or electronic. You are solely responsible for any damage to your computer or mobile device or loss of use. We do not guarantee that the Website will always work properly.

Limitation of Liability
WE SHALL NOT BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT, INCIDENTAL, PUNITIVE, RELIANCE, OR EXEMPLARY DAMAGES, WHETHER IN TORT, CONTRACT, OR ANY OTHER LEGAL THEORY, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THESE TERMS OR YOUR USE OF OR ATTEMPT TO USE THE WEBSITE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, GOODWILL, USE, OR DATA. THIS LIMITATION ON LIABILITY SHALL NOT BE AFFECTED EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW FOR THE EXCLUSION OF IMPLIED WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE. YOU AGREE TO RELEASE US, OUR AFFILIATES, AND OPERATIONAL SERVICE PROVIDERS, EACH ASSOCIATED OFFICER, SHAREHOLDER/DIRECTOR, EMPLOYEE, AGENT, AND REPRESENTATIVE, AND ANY OF THEIR SUCCESSORS AND ASSIGNS FROM CLAIMS, DEMANDS AND DAMAGES (ACTUAL AND CONSEQUENTIAL), OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, DISCLOSED OR UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED TO YOUR USE OF THE WEBSITE.

Governing Law
The headings in these Terms are for convenience and do not control any of its provisions.

Any claim or dispute between you and us arising out of or relating to these Terms, in whole or in part, shall be governed by the laws of the State of Ohio without respect to its conflict of law’s provisions. We agree, and you agree to submit to the personal jurisdiction and venue of the state court located in Franklin County, Ohio and the federal court located in Columbus, Ohio.

Severability and Enforcement
If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the extent necessary to render it enforceable without losing its intent. If no such modification is possible, that provision will be severed from the rest of this agreement.

If we do not enforce any right or provision in this user agreement, that is not to be deemed a waiver of our right to do so in the future.

Entire Agreement
These Terms consist of the entire agreement between you and us concerning the Website. It supersedes all prior or contemporaneous agreements between you and us.

Condado Rewards + Mobile Application

These Terms and Conditions (“Terms and Conditions”) apply to the Condado Rewards Program mobile application (the “App”) and the Rewards Program (as defined below) offered herein, and not to any other website, mobile app, product, service, or program offered by us. The App and the Rewards Program are offered by Condado Tacos and/or its subsidiaries, program partners and administrators, and affiliated companies (“Condado”, “our”, “we”, or “us”). These Terms and Conditions are a legal and binding agreement between you and Condado governing your use of the App and participation in the Rewards Program, which includes their content, information, services, and features, and do not alter in any way the terms or conditions of any other agreement you may have with Condado for other products and services, or the terms or conditions of any other promotional offers or programs that may be conducted by Condado from time to time.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY, AS THEY APPLY TO YOUR USE OF THE APP AND ENROLLMENT AND PARTICIPATION IN THE CONDADO REWARDS PROGRAM. CHECK THESE TERMS AND CONDITIONS DAILY FOR UPDATES OR MODIFICATIONS. BY REGISTERING OR USING A CONDADO REWARDS ACCOUNT OR OTHERWISE PARTICIPATING IN THIS CONDADO REWARDS PROGRAM OR BY CLICKING TO ACCEPT OR AGREE TO THESE TERMS AND CONDITIONS WHEN THIS OPTION IS MADE AVAILABLE TO YOU, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. THESE TERMS AND CONDITIONS INCLUDE A WAIVER OF CERTAIN RIGHTS, INCLUDING THE RIGHT TO SUE IN COURT OR TO PURSUE A CLASS ACTION.

IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU ARE NOT PERMITTED TO, NOR SHOULD YOU ATTEMPT TO, PARTICIPATE IN THE CONDADO REWARDS PROGRAM.

Privacy

Please review our Privacy Policy located at Privacy Policy - Condado (condadotacos.com) (the “Privacy Policy”) to understand our privacy practices, as information collected from you is subject to the Privacy Policy. In addition to the details outlined in the Privacy Policy, in an effort to provide additional transparency, we have included a brief summary below of certain information that may be collected through the App or otherwise as a part of the Rewards Program. This information may include:

Your name,
Your address,
Your email address,
Your telephone number,
Your indication that we are permitted to contact you,
Your indication that you agree to these Terms and Conditions,
Your confirmation that you are at least 13 years of age,
Your birthday month and day, and
Your favorite Condado location,
Your geographic location information, for use when you redeem an Offer redeemable only at certain Condado locations; when you attempt to redeem the Offer, the App may receive such information to confirm you are at the applicable approved Condado location, and
When you place an order through the App at a particular Condado location for pick up, we may receive such information when you physically pick up your order at such Condado location.

By applying for enrollment in, and participating in the Rewards Program, you acknowledge that Condado may use your information as described in our Privacy Policy and as otherwise provided in these Terms and Conditions. You agree to review these Terms and Conditions and the Privacy Policy regularly so that you can make informed decisions about your use of and participation in the Rewards Program, including use and participation through the App (defined below) and the personal information you choose to share with us. You may obtain a copy of our Privacy Policy at any time by calling [614-947-1171 or by visiting Privacy Policy - Condado (condadotacos.com).

Modifications

The Rewards Program is offered at the sole discretion of Condado. Condado reserves the right, in our sole discretion and at any time: (a) to terminate or suspend the Rewards Program, in whole or in part; and (b) to add, delete, or otherwise change any of the Offers, Rewards or these Terms and Conditions, including, but not limited to, changes to prices and charges, changes to the activities by which Rewards may be earned, and changes that may reduce or cancel the redemption value of Offers earned and Rewards credited but not yet redeemed. If we change these Terms and Conditions to provide Rewards for a new activity, no Rewards will be awarded for any such activity that occurred prior to the effective date of the change. Condado may change these Terms and Conditions without prior notice to you, but the current version of the Terms and Conditions will be posted on the App.

As mentioned, we may modify these Terms and Conditions from time to time, or terminate the Rewards Program altogether. If and when we do, we will notify you by email or otherwise as required under applicable law. It is therefore very important that you update your account information or notify us when your email address changes. Any changes to these Terms and Conditions will also be posted here. Your continued use of the App or participation in the Rewards Program after any modification confirms your acceptance to the modifications.

In addition, Condado reserves the right to terminate your participation in the Rewards Program and to invalidate any and all Rewards already earned but not yet redeemed, whether or not credited to or existing in your Rewards Account: (a) in the event of any abuse or fraud relating to the earning or redemption of Rewards, and/or any violation of these Terms and Conditions (including, but not limited to, any attempt to sell, exchange, encumber or transfer Rewards); or (b) for your failure to meet eligibility requirements. We reserve the right, in our sole discretion, to determine whether termination or disqualification is appropriate. We reserve the right to deny access to your Rewards Account or Rewards Account history in the event your Rewards Account is terminated or suspended. These rights are in addition to any other legal or equitable remedy that may be available to us under applicable law.

You may terminate your participation in the Rewards Program at any time and for any reason by contacting us or by cancelling your Rewards Account. If you cancel your Rewards Account, any unredeemed Rewards and/or progress towards other Rewards will automatically expire and will no longer be available for redemption. If you re-enroll at any time, you will start anew, without any Rewards or captured progress towards any Rewards. Because we plan communications in advance, it may take several weeks for your cancellation request to become effective. If you continue receiving communications from us after cancelling your Rewards Account or otherwise expressing an opt-out preference, please bring the matter to our attention so that we can investigate the matter.

Please note a period of extended inactivity on your Rewards Account may result in the termination of your account and forfeiture of Rewards and/or captured progress made toward Rewards. In the event you fail to engage in Rewards Account activity for a period of one (1) year, you will forfeit any earned Rewards that you do not redeem within such one (1) year period.

Condado may, at any time, for any reason, and without notice or liability: (1) suspend, terminate, or modify operation of or access to the App or any portion thereof; (2) change, revise, or modify the App or any portion thereof; (3) interrupt the operation of the App or any portion of the same for maintenance and support; (4) impose limits on certain features of, and services provided in or through, or restrict access to the App; and/or (5) terminate the authorization, rights, and license given above. Upon any termination, the rights and licenses granted to you herein shall immediately terminate, and you must cease all use of the App.

Content & Use

The App and all content, information, and other materials featured, displayed, contained, and available on the App and/or the Rewards Program (collectively, the “Content”) are owned by or licensed to Condado and are protected by copyright, trademark, trade dress, patent, and/or other intellectual property rights or otherwise under the law. Subject to your compliance with these Terms and Conditions, Condado grants you a personal, non-exclusive, non-transferable, limited right to access, use, display, and download this App for noncommercial purposes only. You may not, in any way, otherwise copy, reproduce, distribute, transmit, display, perform, reproduce, publish, license, modify, create derivative works from, sell, or exploit, in whole or in part, the App, the Rewards Program, or the Content.

You agree to use the App and the Content in accordance with these Terms and Conditions and all applicable laws, rules and regulations. Condado may prohibit access, use, conduct, communications, or content that we, in our sole discretion, deem to be harmful to the App, the Rewards Program, the Content, users, us, our brand, or any other person or entity, or that violates these Terms and Conditions and/or applicable law. YOU MAY NOT USE THE APP WHILE OPERATING A VEHICLE. You must use the App only when it is lawful and safe to do so.

Rewards Program

Condado offers the Condado Rewards Program (the “Rewards Program”) to reward and thank our loyal restaurant customers. The Rewards Program is available to enrolled members at participating Condado restaurants in the United States. Rewards accumulated under the Rewards Program are promotional and have no cash value. There are no membership fees associated with the Rewards Program. All questions or disputes regarding eligibility for this Rewards Program, accumulation of and redemption of points and Rewards, or a Participant’s compliance with these Terms and Conditions will be resolved by Condado in its sole discretion.

Eligibility: You may enroll in the Rewards Program if you: (1) are a legal resident of the United States; (2) at least 13 years of age at the time you enroll; (3) have an active, valid e-mail address; and (4) are a human being. No corporations, partnerships, limited liability companies, or other legal entities can participate in the Rewards Program. The Rewards Program is not targeted towards, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and 18, you may only enroll in the Rewards Program under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions.

Enrollment/Rewards Account: You can enroll in the Rewards Program and create a rewards account (“Rewards Account”) by:

Downloading the App at Google Play or Apple’s App Store
Selecting “I’m New!”
Signing up with either a Facebook account or with an email address + phone number and
Making a purchase.

The Rewards Program is open to eligible individuals who establish a Rewards Account as set forth above (each, a “Participant”, or “you” or “your”). Some activities may only be available to those who are at least 18 years or age. The App may only be used while you are physically located in the United States. The Rewards Program is void where prohibited by law. Participation in the Rewards Program constitutes your full and unconditional agreement to these Terms and Conditions. Participants whom do not comply with these Terms and Conditions as determined by Condado in our sole discretion may be prohibited from participating in the Rewards Program. By participating in the Rewards Program, you hereby agree to be bound by these Terms and Conditions and further agrees to receive email and push notification messages from us regarding the status of your Rewards Account, earned Offers and/or Rewards and otherwise as provided herein or in the Privacy Policy or the General Terms of Use.

To enroll in the Rewards Program, you must register for, create and complete an online rewards account (the “Rewards Account”). Creating a Rewards Account is free but is subject to Condado’s general Terms of Use, located at Terms of Use - Condado (condadotacos.com) (the “General Terms of Use”). Capitalized terms used in these Terms and Conditions, but not defined, shall have the same meanings as defined in the General Terms of User. To register for and participate in this Rewards Program, download the App where available and then follow the links and instructions for registration, which includes a requirement that you must affirmatively agree to these Terms and Conditions. There is a limit of one (1) Rewards Account per person. There is also a limit of one (1) Rewards Account per mobile number and email address. Participant will be required to provide the requested information, including, but not limited to, user name, password, name, and e-mail address. The person who creates a Rewards Account using a mobile number or email account represents and warrants that he or she is the authorized holder of that mobile number and email account, and is authorized to create the Rewards Account and provide the information to us.

In order to use and participate in the Rewards Program through the App, you must have a compatible device. Condado makes no representation or warranty that the App will be compatible with your device. You represent to Condado that you have obtained permission from the owner(s) of the mobile telephone or handheld devices that are controlled, but not owned, by you, and to download a copy of the App onto such devices. You and such owner(s) may be charged by your and such owners’ service providers for internet access and activity on such devices. You are responsible for any devices, software and services needed to use the App. Condado does not guarantee the App will fully function on any particular device or with any particular software. Without limiting the forgoing, you are also responsible for any messaging and data charges, fees and taxes for your use of the App or participation in the Rewards Program, including, without limitation, when Condado communicates with you by text message (if applicable), email or other means that you choose and earning or redeeming Rewards. If you create a Rewards Account, you are responsible for keeping the Rewards Account secure and for all activity under the Rewards Account.

From time to time Condado may issue updates to the App made available through app stores, or the App may automatically download and install updates from time to time or require the downloading and installation of updates or new versions for continued use. You acknowledge that, depending on the update, you may not be able to use the App or otherwise participate in or use the Rewards Program until you have downloaded the latest version of the App and accept any new terms and conditions that may apply, and that in some instances updates and/or new versions may reduce or remove features and functionality in prior versions of the App.

You may earn and redeem Rewards only at participating Condado locations, which are subject to change from time to time at our sole discretion.

As referenced above, certain features or services offered on or through this App require you to complete a registration process and/or setup a Rewards Account and login. In connection with that process and your Rewards Account, you agree to (1) provide true, accurate, current, and complete information about yourself, and (2) maintain and promptly update your information to keep it true, accurate, current, and complete. You are entirely responsible for maintaining the confidentiality of the information you hold for your login, including your password. You agree to notify Condado immediately of any unauthorized use of your login, or any other breach of security. You may be held liable for losses incurred by Condado or any other App user or Rewards Program Participant due to someone else using your login as a result of your failing to keep your login information secure and confidential.

You may not use anyone else’s Rewards Account or login information. Condado shall not be liable for any loss or damage arising from your failure to comply with these obligations.

Your Rewards Account is personal to you and may not be sold, transferred or assigned to, or shared with family, friends or others. You may have only one (1) Rewards Account.

As a part of the Rewards Program, Condado will send you transactional, informational, and promotional messages and/or offers. These communications may happen in the form of push notifications through the App, email, SMS text messages and/or any other ways you may have selected when you enrolled in the Rewards Program. If your contact information changes, or if you wish to change your contact information or the method by which we send you messages, please log into your Rewards Account and update your contact information or preferences. Condado will not contact you by text message without your prior express written consent. We will not charge you for text messages; however, message and data rates may apply. You may opt out of receiving text messages or notifications by following the opt-out instructions included with such messages or by logging into your Rewards Account and updating your contact information and preferences.

Qualifying Purchases: You will earn and receive points toward Rewards by making qualified purchases at participating Condado locations and scanning the bar code on the receipt from your purchase with the built in scanner in the App or uploading a photo of your receipt within 24 hours of your purchase. You will earn one point per $1 spent at a participating Condado location. After the qualifying purchase is verified, the points you have earned will be applied to your Rewards Account. You can track the points and Rewards you have already earned and that you may earn in the future by logging into your Rewards Account History.

Some exclusions apply. Purchases of catering items and services, alcoholic beverages or Condado gift cards (including activations or reloads) are not considered qualifying purchases and do not accumulate points. Taxes, tips, donations, and fees, including without limitation, delivery fees, bag fees and recycling deposits, will also be excluded from a purchase total when computing qualifying purchases and do not accumulate points. If you void or cancel a qualifying purchase yet still accumulate points for such purchase, Condado reserves the right to deduct the points associated with that purchase from your Rewards Account at any time.

Earning Points: To earn points, follow these steps:

Open the App and select the “Rewards” tab
Tap “Earn”
Present the resulting QR code to your Condado server to scan before payment.
After the server scans the QR code, the points you’ve earned will be displayed within 24 hours.

In the even you forget to scan the QR code at the Condado location, you may still earn points for your purchase within 24 hours of payment if you follow these steps:

Open the App and select the “Rewards” tab
Tap “Earn”
Utilize your smartphone camera, which will be enabled, to scan the barcode printed at the bottom of your receipt. In the event the scan is unsuccessful, you may enter the barcode manually by typing in the 12-13 digit number displayed on the receipt.

For your convenience, online orders submitted via the App while you are logged into your Rewards Account will automatically generate points. Such points may not show up in your account immediately, but they will be displayed within 24 hours of your purchase.

Rewards: By accumulating points in your Rewards Account, you will earn banked rewards, as set forth below, as well as other rewards that may be offered from time to time (each, a “Reward”), which you may redeem at participating Condado locations (subject to these Terms and Conditions and any terms provided in connection with such other, non-banked rewards). Once you earn a Reward, you may start accumulating points towards another Reward. A Reward may not be combined with any other offer or coupon.

When you accumulate 50 points, you will earn a $5 Reward redeemable at any participating Condado location. In addition to earning Rewards, you will have the ability to achieve new membership levels throughout a single year of purchases, according to the following table:

Membership levels will reset after each 365 days of your membership. No points will carry over from year to year. Neither earned points nor earned Rewards are transferable.

Redeeming Points/Rewards: To redeem points, follow these steps:

Open the App and selected the “Rewards” tab
Tap “Redeem”
Choose the Reward or Reward amount for which you would like to use/redeem points. If you have met the necessary requirements for the selected Reward, the Reward will be displayed in your Rewards Account.
Show the QR code tied to the banked Reward you wish to use to your server, and allow the server to scan the QR code prior to payment to utilize the Reward.

Note: once a Reward has been selected for use/redemption, you will have a limited time to utilize/redeem the Reward at a participating Condado location. A 4 hour clock will count down to zero to notify you of the pending expiration of the selected Reward. Rewards that expire after having been selected for use/redemption but that are not used/redeemed will be lost, and Condado will not replace or replenish such Rewards or their equivalent in points or otherwise.

Promotional Offers: Through the App and the Rewards Program, Condado may, from time to time and at our sole discretion, provide Participants with opportunities to receive various promotional offers, coupons, or other deals (each, an “Offer”). Such Offers may be provided, for any reason or no reason, at random, periodically, seasonally, regionally, or based upon your use of the App, including your order history, personal information provided to Condado, and any other details relating to you, your use of the App, your participation in the Rewards Program, or otherwise as we may determine. Some Offers may include specific instructions and requirements related to how you may earn the Offer, including, but not limited to, requiring you to first purchase other menu items before the Reward (as defined below) is earned (e.g., buy ten tacos to earn a free Reward). You must follow all such instructions and complete all requirements prior to redeeming an Offer and earning a Reward.

In addition to as otherwise provided in these Terms and Conditions, without limiting our rights or remedies, the following terms apply to Offers:

An Offer may only be available to a Participant for redemption through the App,
An Offer may only be available and redeemed for the product shown or described on or through the App,
An Offer is subject to availability at the Condado location at which you attempt to redeem the Offer.
An Offer may only be redeemed on or before the expiration date, and only at a participating Condado location.
An Offer may only be redeemed once
Certain Offers may not be combined with other orders or offers (including other Offers).
Offers may not be exchanged for cash or other Offers, and have no cash value.
The time at which a Participant attempts to redeem an Offer may impact the availability of and ability for Participant to redeem the Offer (Offers are limited while supplies last).
An Offer is not transferrable.

Any additional terms set forth on or through the App for an Offer or otherwise made available by Condado will apply.

After the referred individual signs up with the unique referrer code and makes first purchase, the referred individual will receive 10 bonus points.

Additional Rewards Program Terms: Condado reserves the right to terminate your Rewards Account and/or your participation in the Rewards Program if we determine in our sole discretion that you have violated these Terms and Conditions, you have more than one (1) account, or that the use of your account is unauthorized, deceptive, fraudulent or otherwise unlawful. Condado may, in its sole discretion, suspend, cancel, or combine Rewards Accounts that appear to be duplicative, and may refuse to allow you to re-enroll in the Rewards Program. Condado also reserves the right to “unregister” and make ineligible for the Rewards Program any Rewards Account that has been inactive for one (1) year. Inactive is defined as no Rewards earned.

Condado has the right at any time, with or without giving you prior notice, to:

End or cancel the Rewards Program and/or any specific Offer or Reward;
Change any Reward or other Rewards Program benefit we offer;
Change the requirements for earning a particular Reward;
Change the time you have in which to earn a particular Reward; and/or
Change any other feature of the Rewards Program.

If we end the Rewards Program, Rewards you have earned but not used will expire on the end date, and you may not redeem any Rewards or use any credits after the end date.

Migrating Prior Rewards Points: former participants in Condado’s rewards program that predated the current Rewards Program are permitted to migrate their points under the former program to the new Rewards Program when signing-up for a Rewards Account under the Rewards Program. To migrate points, follow these steps:

Download the App from either Google Play (Android) or the Apple App Store (iOS).
Select “Migrate Rewards” and enter login info associated with former rewards account.
Enter the verification code emailed to the email address associated with your former account and submit.
Start earning points with purchase!

Migrated points will convert to applicable points and/or Rewards (e.g., 150 points from former rewards program will convert to three (3) $5 Rewards under the new Rewards Program). If you do not remember your login information for the prior rewards program, you will not be permitted to carry-over any points from the former program to the new Rewards Program. Sorry, bud, you’ll have to start fresh.

No Warranties

THE APP, THE CONTENT, AND THE REWARDS PROGRAM ARE PROVIDED ON AN “AS IS”, AND “AS AVAILABLE” BASIS, AND CONDADO HEREBY EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, CONDADO DOES NOT GUARANTEE THAT THE APP, THE CONTENT OR THE REWARDS PROGRAM WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitations of Liability

Condado, its affiliates, subsidiaries, and promotional and advertising agencies are not responsible for any printing or computer error, omission, interruption, irregularity, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alteration of Rewards Program materials or Rewards, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, unauthorized access to Rewards Accounts, or inaccurate transmission of Rewards Program or other information due to technical problems or traffic congestion on the internet, at any web site or any combination thereof.

By participating in the Rewards Program, you accept all responsibility for, and hereby release and agree to indemnify and hold harmless Condado and its respective parent companies, subsidiaries, affiliates, agents, promotion and advertising agencies, and each of their respective officers, directors, employees, shareholders, and successors, assigns, and service providers from and against any claims, liabilities, damages, or expenses that may arise from actions taken by you and/or your participation in the Rewards Program, or for any harm or injury caused by any third party.

NOTWITHSTANDING ANYTHING TO THE CONTRARY, UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, CONDADO’S NEGLIGENCE, SHALL CONDADO OR ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH THE APP, THE CONTENT, OR THE REWARDS PROGRAM OR PARTICIPANTS USE, OR INABILITY TO USE, THE REWARDS PROGRAM, THE APP, OR THE CONTENT, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY. WITHOUT LIMITING THE FORGOING, IF CONDADO IMPROPERLY DENIES A PARTICIPANT ANY REWARD, CONDADO’S AGGREGATE LIABILITY WILL BE LIMITED TO THE EQUIVALENT FAIR MARKET VALUE OF THE REWARD.

BY PARTICIPATING IN THE REWARDS PROGRAM, PARTICIPANT WAIVES ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE (1) YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE DISPUTE IS BASED. BECAUSE SOME STATES DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, IN SUCH JURISDICTIONS, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.

Communications

When you visit the App or send e-mails or text messages to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail, mail, phone or by posting notices on or through the App. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You further agree that any notices provided by us electronically are deemed to be given and received on the date we transmit any such electronic communication as described in these Terms and Conditions. You acknowledge that messages transmitted via the internet are never completely private or secure, and understand that any message or information you send using the App or any related service may be read or intercepted by others.

You acknowledge the methods by which we may contact you, and agree to receive any and all Offers, Rewards, correspondence, transaction confirmations and other information from Condado, whether provided electronically through the App, your Rewards Account or the email address or other information provided by you to Condado. Condado will not be responsible for your inability to connect to the Internet or to access the Rewards Program or App or inability to receive electronic communications. Electronic communications are presumed to be delivered to and received by you when sent by Condado, whether actually received or not. From time to time Condado may monitor and record telephone calls for training or compliance purposes, to provide a record of your instructions or to assure the quality of our service and you hereby consent to the monitoring and recording of your telephone conversations with Condado. In addition, we may periodically use prerecorded voice messages or use an automatic dialing device to make calls and send text messages (if you opt-in) to any telephone number associated with your Rewards Account. You agree that we may rely on any oral and electronic instructions from you to us. You are solely responsible for updating the contact information in your Rewards Account should there be any change in your name, address (including email address you use with Condado), telephone number, or any other contact information required by Condado for purposes of the Rewards Program.

International Users

The App is controlled, operated, and administered by Condado from offices within the United States of America. We make no representation regarding use of the App outside of the United States. You may not use the App or export any portion of it in violation of U.S. export laws and regulations. If you access the App from locations outside of the United States of America, you are responsible for compliance with all local laws.

Governing Law/Venue

The App and Rewards Program are governed by and subject to the laws of the State of Ohio, USA and, where applicable, U.S. federal law, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction and venue of the courts located in the State of Ohio, in each case located in the City of Columbus and Country of Franklin for any disputes arising out of these Terms and Conditions, the App, and/or the Rewards Program. Notwithstanding this provision, you agree that Condado may apply for injunctive or other equitable relief in any court of competent jurisdiction. Participant waives any and all objections to the exercise of jurisdiction over Participant by such courts and to venue in such courts.

You agree that whenever you have a dispute with Condado arising out of or relating to the App and/or the Rewards Program, you will send a written notice to Condado (a “Demand”). You agree that the requirements of this paragraph will apply even to disputes that may have arisen before you accepted these Terms and Conditions. You must send the Demand to the following address (the “Notice Address”): Condado Rewards Program Legal Disputes, 34 W. Gay, Columbus, OH 43215. You agree that you will not take any legal action, including filing a lawsuit or demanding arbitration, until 15 business days after you send a Demand to the Notice Address. If the disagreement stated in the Demand is not resolved to your satisfaction within such 15 business days, the remainder of this Section controls. At Condado’s sole discretion, Condado may require Participant to submit any disputes arising from these Terms and Conditions or the Rewards Program, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Ohio law.

General Provisions

All or any of our rights and obligations hereunder may be assigned to a subsequent owner or operator of the App and/or Rewards Program in a merger, acquisition or sale of all or substantially all Condado assets. If, for any reason, a court of competent jurisdiction finally determines any provision of these Terms and Conditions or any portion thereof to be unenforceable, such provision will be enforced to the maximum extent permissible so as to give the intended effect thereof, and the remainder of these Terms and Conditions will continue in full force and effect.

Any attempt by any person to undermine the legitimate operation of the Rewards Program may be a violation of criminal and civil law, and, should such an attempt be made, without limiting our rights or remedies, we reserve the right to seek damages from any such person to the fullest extent permitted by law. Our failure to enforce any term or condition of these Terms and Conditions shall not constitute a waiver of any such term or condition, or any other term or condition. Without limiting our rights or remedies, we shall have the right to take appropriate administrative and/or legal action, including seeking criminal prosecution, as we deem necessary in our sole discretion.

Condado is not responsible for any incorrect or inaccurate information supplied by Participants while participating in this Rewards Program. You represent to Condado that all information provided or otherwise made available by you is true, accurate and correct, you have the right to provide and otherwise make such information available, and Condado and its representatives may rely on such information.

These Terms and Conditions and the General Terms of Use constitute the sole and entire agreement between Participant and Condado with respect to the Rewards Program and your participation in it, and any and all prior agreements with respect to any other rewards program are superseded by these Terms and Conditions. In the event of a conflict between the terms and conditions of these Terms and Conditions and the General Terms of Use, the terms and conditions of the General Terms of Use shall control. Nothing contained herein limits our rights or remedies under the General Terms of Use.

All registered marks, trademarks and service marks belong to their respective owners. CONDADO is a trademark of Condado. Headings are for ease of reading and do not restrict or alter the meaning of any provision within these Terms and Conditions.
